Direct debit terms

If you have elected to make a payment via direct debt from your Bank Account or Debit Card either electronically through the PRA Australia Customer Portal, via a manual form or by telephone the following Direct Debit Service Agreement was included in your confirmation and applies to your ongoing arrangement:

  • You hereby authorise SR Global Solutions Pty Ltd ACN 132 951 172 (Direct Debit User ID number 397351) (herein referred to as “Merchant Warrior”) to make periodic debits on behalf of PRA Australia (herein referred to as “PRA”) as indicated within your Arrangement Confirmation (herein referred to as “DDR”).
  • You acknowledge that Merchant Warrior will keep any information (including your personal and account information) in your DDR confidential. Merchant Warrior will make reasonable efforts to keep any such information that it may have about you secure and to ensure that any of its employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.
  • Merchant Warrior will only disclose information that we have about you:
    1. (1) to the extent specifically required by law; or
    2. (2) for the purposes of this agreement (including disclosing information in connection with any query or claim).
  • You acknowledge that Merchant Warrior is acting as a Direct Debit Agent for PRA and that Merchant Warrior does not provide any goods or services (other than the direct debit collection services to you for PRA pursuant to the DDR and this DD Service Agreement) and has no express or implied liability in regards to the goods and services provided by PRA or the terms and conditions of any agreement that I/we have with PRA.
  • You acknowledge that the debit amount will be debited from your account according to the terms and conditions of your agreement with PRA and the terms and conditions of the DDR (and specifically the Debit Arrangement detailed in the DDR) and this DD Service Agreement.
  • You acknowledge that bank account details have been verified against a recent bank statement to ensure accuracy of the details provided and you will contact your financial institution if you are uncertain of the accuracy of these details.
  • You acknowledge your responsibility to ensure that there are sufficient cleared funds in the nominated account by the due date to enable the direct debit to be honoured on the debit date. Direct debits normally occur overnight, however transactions can take up to three (3) business days depending on the financial institution. Accordingly, you acknowledge and agree that sufficient funds will remain in the nominated account until the direct debit amount has been debited from the account and that if there are insufficient funds available, you agree that Merchant Warrior will not be held responsible for any fees and charges that may be charged by your financial institution. You may also incur fees or charges imposed or incurred by PRA.
  • You acknowledge that you must arrange for a dishonoured debit payment to be made by another method or arrange for sufficient clear funds to be in your account, by an agreed time, so that, if agreed, we can reprocess the debit payment. If you do not make an arrangement to rectify the dishonoured payment, and associated fees, this Direct Debit arrangement may be cancelled by PRA, without prior notice to you — any agreement to pay off the remaining balance over time or at a reduced rate will become immediately due and payable.
  • You acknowledge that there may be a delay in processing the debit if:-
    1.   (1) there is a public or bank holiday on the day of the debit, or any day after the debit date;
    2.   (2) a payment request is received by Merchant Warrior on a day that is not a banking business day in Queensland;
    3.   (3) a payment request is received after normal Merchant Warrior cut off times, being 4:00pm New South Wales time, Monday to Friday.

      Any payments that fall due on any of the above will be processed on the next business day.

  • If you want to make changes to the direct debit drawing arrangements, you must contact PRA by phone or in writing (this includes email). These changes may include:
    • date, the scheduled frequency and/or the scheduled payment amount;
    • Changing Bank Account, Debit Card or Credit Card Details;
    • Cancelling the DDR;
    • Suspending the DDR.
  • Any requested changes to the due date, the scheduled frequency and/or scheduled repayment amount, if agreed to by PRA, or changes to the Bank Account, Debit Card or Credit Card to be debited, will require you (or the bank account holder) to complete a new DDR either electronically through the PRA Australia Customer Portal, via a manual form, via email or by telephone.
  • You authorise Merchant Warrior to vary the amount of the payments from time to time as may be agreed by you and PRA as provided for within your agreement with PRA. You authorise Merchant Warrior to vary the amount of the payments upon receiving instructions from PRA of the agreed variations. You do not require Merchant Warrior to notify you of such variations to the debit amount.
  • You acknowledge that Merchant Warrior and/or PRA is to provide at least 14 days’ notice if it proposes to vary any of the terms and conditions of the DDR or this DD Service Agreement including varying any of the terms of the debit arrangements between us.
  • If you wish to notify the Business in writing about anything relating to this agreement, you should write to:

  • The Business / Merchant Warrior will notify you by sending a notice to the preferred address or email you have given us in the Direct Debit Request.
  • Any notice will be deemed to have been received on the second banking day after sending. You acknowledge that any request by you to stop or cancel the debit arrangements will be directed to PRA.
  • You acknowledge that any disputed debit payments will be directed to PRA and/or Merchant Warrior. If no resolution is forthcoming, you agree to contact your financial institution. If PRA cannot substantiate the reason for drawing, you will receive a refund of the drawing amount.
  • You acknowledge that if a debit is returned by your financial institution as unpaid, a failed payment fee is payable by you to Merchant Warrior. You will also be responsible for any fees and charges applied by your financial institution for each unsuccessful debit attempt together with any collection fees, including but not limited to any solicitor fees and/or collection agent fee as may be incurred by Merchant Warrior.
  • You authorise Merchant Warrior to attempt to re-process any unsuccessful payments as advised by PRA.
  • You acknowledge that certain fees and charges (including setup, variation, SMS or processing fees) may apply to the DDR and may be payable to Merchant Warrior and subject to your agreement with PRA agree to pay those fees and charges to Merchant Warrior.
